This is an CPLR Article 75 proceeding to compel respondent State Farm Indemnity Company to participate in an arbitration with the petitioners pursuant to an uninsured motorist endorsement. All of the issues raised by the parties, save one, were, with the courts assistance, resolved by way of a "so ordered" stipulation at the March 2, 2005 oral argument. In paragraph 9 of the stipulation, the parties agreed that this court will determine the choice of law to be applied by the arbitrator. For the reasons set forth below, the court concludes that New York law shall apply.
